1. General Provisions
1.1. The Personal Data Operator makes it its most important goal and condition for carrying out its activities to comply with the rights and freedoms of individuals during the processing of their personal data, including the protection of the right to privacy of private and family life.
1.2. Within the framework of this Nucular Network Privacy Policy, the Customer interacts with the Personal Data Operator (clause 2.1.7 of this Privacy Policy) when using the Nucular Services.
1.3. The Customer must read this Privacy Policy before using the functionality of the Nucular Services.
1.4. If the Customer does not agree with any point of this Privacy Policy, they should refrain from further use of the Nucular Services.
1.5. This Privacy Policy applies to all information that the Personal Data Operator can obtain from the Customer in the course of the Customer using the Nucular Services.
1.6. This Privacy Policy only applies to the Nucular Services. The Personal Data Operator does not control or take responsibility for third party sites that the Customer can access via links available on the Nucular Services. On such sites, other personal information may be collected or requested from the Customer, and other actions may be taken.
1.7. This Nucular Network Privacy Policy (hereinafter referred to as the "Privacy Policy") has been developed in accordance with the requirements of the legislation of the Personal Data Operator's country and regulates the legal relationship in the field of personal data processing between the Customer and the Personal Data Operator.
2. Terms and Definitions
2.1. In this Privacy Policy, unless otherwise stated by context, the capitalized terms below have the following meanings:
2.1.1. Blocking of personal data - temporary termination of personal data processing (excluding cases where processing is necessary to clarify personal data).
2.1.2. Manufacturer - Nucular Limited (Business registration number: 73773696, Business address Room 5003, 5/F Yau Lee Centre, 45 Hoi Yuen Road Kwun Tong Hong Kong, Hong Kong, Hong Kong, 999077) and/or its affiliated entities, as well as authorized employees acting on behalf of Nucular Limited, carrying out entrepreneurial activities for the production and sale of Products, including remotely via the Nucular Services.
2.1.3. Personal data information system - a set of personal data contained in databases and ensuring their processing by information technologies and technical means.
2.1.4. Confidential data - data left by Nucular Services Customers in feedback forms and applications, Cookies, as well as data automatically transmitted during use of the Nucular Services, including but not limited to: IP address, device information from which access is made, etc.
2.1.5. Anonymization of personal data - actions that make it impossible to determine without using additional information the affiliation of personal data to a particular Customer or other personal data subject.
2.1.6. Processing of personal data - any action (operation) or set of actions (operations) performed using automated means or without using such means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (dissemination, provision, access), anonymization, blocking, deletion, destruction of personal data.
2.1.7. Personal Data Operator (hereinafter referred to as the "Operator") - LLC "Inzheneris" (BIN 221140035737, Kazakhstan, Almaty, Tole bi str., 101), and/or its affiliated entities, as well as authorized employees acting on behalf of LLC "Inzheneris", which organize and/or carry out the Processing of personal data, as well as determine the purposes of processing personal data, the composition of personal data subject to processing, actions (operations) performed with personal data.
2.1.8. Personal data - any information relating directly or indirectly to an identified or identifiable Customer during use of the Nucular Services, including personal data that the Customer provides about themselves (name (including pseudonym), email address, phone number, delivery address and other information).
2.1.9. Customer - any adult visitor to the Nucular Service, including those having a personal account on the Nucular Services.
2.1.10. Provision of personal data - actions aimed at disclosing personal data to a specific person or specific group of persons.
2.1.11. Dissemination of personal data - any actions aimed at disclosing personal data to an indefinite circle of persons (transfer of personal data) or familiarizing an unlimited number of persons with personal data, including the publication of personal data in the media, placement in information and telecommunication networks or providing access to personal data in any other way;
2.1.12. Nucular services - a set of graphic and informational materials, as well as computer programs and databases that provide access to them on the internet at the network address https://nucular.tech and related mobile and other web applications.
2.1.13. Nucular network - a set of legal entities and individual entrepreneurs operating within the framework of separate contracts under the trademark and/or commercial designation Nucular.
2.1.14. Products - controllers and other related products manufactured by the Manufacturer under the trademark and/or commercial designation Nucular, presented on the Nucular services by placing photo samples and textual descriptions. Products may differ from the image on the Nucular services.
2.1.15. Cross-border transfer of personal data - the transfer of personal data to the territory of a foreign state to a government authority of a foreign state, a foreign individual or a foreign legal entity;
2.1.16. Destruction of personal data - any actions as a result of which personal data is irretrievably destroyed without the possibility of further restoration of the content of personal data in the personal data information system and (or) the result of which destroys material carriers of personal data.
2.1.17. Cookies - a small piece of data sent by the web server and stored on the Buyer's computer, which the web client or web browser sends to the web server in each HTTP request when attempting to open a page of the corresponding site.
2.2. For the purposes of this Privacy Policy, terms and definitions in the singular also apply to terms and definitions in the plural and vice versa.
3. Purposes of collecting and processing personal data
3.1. The Operator may process the Buyer's Personal Data for the following purposes:
-Providing the Buyer with access to information and/or materials contained on the Nucular Services.
-Communicating with the Buyer, including sending notices, requests and information regarding the use of the Nucular Services.
-Providing services for ordering and delivering the Manufacturer's Products listed on the Nucular Services, as well as processing requests and applications from Purchasers.
-Sending the Buyer notifications about new products and services, special offers and various events.
-Conducting statistical, analytical and other research based on the data provided, including to improve the quality of the Nucular Services, and the convenience of its use.
-Providing customer service to Purchasers, providing answers to questions, reviews, considering claims and/or disputes.
-Confirming the Buyer's identity and purchases in connection with requirements related to the Products warranty or post-sale servicing.
3.2. The Operator may use the Buyer's Personal Data for other purposes as well, if permitted under applicable data protection laws.
3.3. The Buyer can always opt-out of receiving promotional messages by sending an email to info@nucular.tech with the note "Opt-out of notifications about new products and services and special offers".
3.4. The Buyer's anonymized data collected through internet statistics services is used to gather information about the Buyer's actions on the Nucular Services, improve the quality and content of the Nucular Services.
3.5. If the Buyer voluntarily provides additional sensitive personal data (e.g. data on political views, data on racial affiliation, etc.), including in comments and/or reviews, then the Buyer shall be fully responsible for all consequences of publishing such information.
4. Terms of processing personal data
4.1. The Operator processes the Buyer's personal data only if it is filled out and/or sent by the Buyer independently through special forms located on the Nucular Services.
4.2. By filling out the relevant forms and/or sending their personal data to the Operator, the Buyer fully and unconditionally accepts all provisions of this Privacy Policy (including checking the box "By clicking the 'SEND' button, you consent to the processing of personal data and agree to the Privacy Policy", "User Agreement" and "Terms of Sale of Products of the Nucular Network").
4.3. The Buyer's consent to the Processing of their personal data is valid from the day it is received by the Operator in accordance with clauses 4.1. and 4.2. of this Privacy Policy until the day consent is withdrawn by sending a written request to the Operator.
4.4. The period of processing personal data is unlimited. The Buyer may at any time withdraw their consent to the processing of personal data by notifying the Operator by email at info@nucular.tech marked "Withdrawal of consent to process personal data".
4.5. Personal data permitted for processing under this Privacy Policy includes:
-Full name and/or Company Name of the Buyer;
-Email address;
-Phone numbers in the international format +X (XXX) XXX-XX-XX;
-Products delivery address (including postal code, country, city, street, house and office number).
-Information about Products purchased by the Buyer, including purchased and returned items and their quantity, order payment information, information about complaints and/or requests.
4.6. In the event of inaccuracies in personal data, the Buyer can update them independently by notifying the Operator by email at info@nucular.tech marked "Updating personal data".
4.7. The Operator has the right to block, delete, remove information posted by the Buyer on the Nucular Services without the Buyer's consent if such information does not comply with current legislation and the provisions of this Privacy Policy.
4.8. The Operator has the right to collect and process the Purchasers' anonymized data that is automatically transferred during use (including "Cookie" files to store the Buyer's IP address) using internet statistics services (Google Analytics and others). These programs are used to collect and process anonymized data about visits to the Nucular Services without tying it to the Buyer's personal data. Information obtained through Cookies can also be used by the Operator for statistical research aimed at adjusting the content of the Nucular Services in accordance with the Buyer's preferences. The Buyer can change the Cookie receipt settings in their browser settings or disable them completely, however in this case some functions of the Nucular Services may work incorrectly.
4.9. The Operator does not check the authenticity of the personal information provided by the Buyer. At the same time, the Operator assumes that the Buyer provides accurate and sufficient personal information, and keeps this information up to date.
4.10. The Operator has the right to provide the Buyer's personal data to third parties, including through the cross-border transfer of personal data, in the following cases:
-for the Buyer to use the Nucular Services or for services to be provided to the Buyer;
-to fulfill the terms of the User Agreement, Terms of Sale of Products of the Nucular Network and other contracts for the supply of Products to the Buyer from the Manufacturer.
-for the purpose of ensuring the possibility of protecting the rights and legitimate interests of the Operator or third parties in cases where the Buyer violates the legislation, the terms of the Privacy Policy, the Nucular Network User Agreement and the Terms of Sale of Products of the Nucular Network.
-in the event of a sale or other transfer of the Operator's business (fully or partially), in which case all obligations to comply with the terms of this Privacy Policy are transferred to the acquirer.
-in other cases not contrary to the legislation.
4.11. Prior to commencing the cross-border transfer of personal data, the Operator must ensure that the foreign state to whose territory the transfer of personal data is planned provides reliable protection of the rights of personal data subjects.
4.12. Cross-border transfer of personal data to territories of foreign states that do not meet the above requirements can only be carried out with the written consent of the personal data subject to the cross-border transfer of their personal data and/or the execution of a contract to which the personal data subject is a party.
4.13. The Operator may record telephone conversations with the Buyer, regardless of whether or not the Buyer's corresponding consent is obtained/not obtained, if such actions are necessary for the Buyer to fulfill their obligations, including to improve the quality of services provided to the Buyer.
5. Obligations of the Parties
5.1. The Buyer must:
5.1.1. Provide up-to-date data requested on the Nucular Services at the time of use.
5.1.2. Update and supplement the provided data in case of changes to this information.
5.1.3. Obtain all necessary consents from third parties in the event their data is provided to the Operator.
5.2. The Operator must:
5.2.1. Use the received personal data exclusively for the purposes stipulated in this Privacy Policy.
5.2.2. Ensure the confidential information is kept secret, not disclose it without the Buyer's prior written permission, and not sell, exchange, publish or otherwise disclose personal data except as provided by law, this Privacy Policy and contracts concluded with Purchasers.
5.2.3. Take precautions to protect the Buyer's confidential data according to procedures typically used to protect such information in existing business practices and in accordance with legal requirements.
6. Measures applied to protect the User's personal data
6.1. The security of personal data processed by the Operator is ensured by implementing legal, organizational and technical measures necessary to fully comply with the requirements of applicable personal data protection legislation, including from unlawful or accidental access, destruction, modification, blocking, copying, provision, distribution of personal data, as well as other unlawful actions in relation to personal data.
6.2. The Operator ensures the protection of personal data and takes all possible measures to prevent unauthorized access to personal data, including:
-Appoints a person responsible for organizing the processing of personal data.
-Appoints an officer (employee) responsible for ensuring the security of the Buyer's personal data in the personal data information system.
-Carries out internal control and/or audit of compliance of personal data processing with applicable legislation.
-Informs its employees directly involved in personal data processing about the provisions of applicable legislation, including personal data protection requirements, as well as the provisions of this Privacy Policy.
-Identifies threats to the security of personal data when processed in personal data information systems.
-Prevents attempts of unauthorized access to personal data and takes appropriate measures.
-Establishes rules of access to personal data processed in the personal data information system, and also ensures registration and records of all actions performed with personal data in the personal data information system.
-Monitors the measures taken to ensure the security of personal data and the level of protection of personal data information systems.
-Organizes a security regime for premises housing the personal data information system, preventing uncontrolled entry or presence of persons not authorized to access these premises.
-Ensures the integrity of personal data media.
-Approves a document defining the list of persons whose access to personal data processed in the information system is necessary to perform their official (job) duties.
-Uses information security tools that have undergone assessment procedures to comply with information security legislation requirements, if such tools are necessary to neutralize actual threats.
7. Concluding provisions
7.1. This Privacy Policy is governed by the norms of the legislation in force in the location of the Personal Data Operator.
7.2. Any disputes and disagreements that may arise in connection with the execution of this Privacy Policy will be resolved by the parties through negotiations.
7.3. In the event that the parties do not reach an agreement, disputes will be resolved in the relevant courts at the location of the Personal Data Operator.
7.4. The Operator has the right to make changes to this Privacy Policy. The Privacy Policy is valid indefinitely until replaced by a new version. When changes are made to the current edition, the date of the last update is indicated. The Buyer is obliged to independently monitor changes to this Privacy Policy. The new edition of the Privacy Policy enters into force from the moment it is published, unless otherwise provided for in the new edition of the Privacy Policy. The current version of the Privacy Policy is freely available on the Nucular Services.
